1. Acceptance of Terms
By joining Yoga Insurance UK, you agree to follow the terms and conditions, detailed in this Terms of Use document.

Please note that this document will hereon refer to the use of our website as use of the 'Service'.

You confirm that all the details you have given are 100% accurate. Falsifying information may result in the cancellation of your membership and insurance with no refund.

Members of Yoga Insurance UK, agree to abide by posted guidelines, which may change from time to time. If you object to a term or condition detailed, or future modifications made to them, your recourse is to discontinue membership which will cancel your insurance.

2. Modifications to this Agreement
We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms of Use at any time. Such modifications shall become effective immediately upon the posting thereof. You must review this agreement regularly to keep yourself apprised of any changes.

The Terms of Use are valid up to and until you cancel your membership.

3. Membership Fees

Prices are as stated at the time of purchase. Your insurance is active once we are satisfied that you meet the conditions to join.

Renewal payments are automatically deducted annually from the card held on file unless you inform us not to or cancel your membership.

4. New Members

We do not require to see a copy of your teacher training certificate. In the event of an insurance claim, Balens Ltd will need to see a copy of your certificate. If you fail to provide this or it doesn't meet our minimum requirements, your insurance will be invalid. The onus is on you to have a valid training certificate. Note the minimum requirements for membership is 40 hours of yoga teacher training.

5. Receiving Insurance Documents

Once your membership is approved, we will send your insurance documents to the email address you supplied on the application form. You should receive them within one working day after payment is made, unless you have selected to have therapies insurance.

6. Membership Dates and Insurance

Your membership and insurance start from the date that you made payment.

7. Membership Renewal
Memberships are set to auto-renew each year. If you do not wish to auto-renew, it is your responsibility to inform Yoga Insurance UK by email when you make your application.

To keep your insurance valid, you must renew your membership on an annual basis. You will receive a renewal reminder email in the month before your renewal date. Yoga Insurance UK will bill the credit or debit card held on file and in the amount of the current Membership Fee.

To prevent breaks in your membership and insurance, you must contact us if your card details change.
If you do not wish to renew your membership, you must give 7 days written notice to cancel the upcoming payment. Alternatively you can cancel the payment on your payment personal portal.
An automatic renewal extends the current expiry date of the membership by one year. The renewal term begins the day you make the renewal payment.

Non-renewal of your membership will result in the cancellation of your membership and insurance.

8. Cancellation Policy

After joining you may cancel within the 14-day cooling-off period, you can change your mind for any reason and request to cancel your membership. If your membership is active and you have been sent your insurance documents, a £25 administration fee will be removed from the refund.

Out with the cooling-off period, you may still cancel. However, there is a strict NO REFUND policy under any circumstances.

To cancel please contact us, giving the reason you wish to cancel.

9. Cancellation After Renewal Payment
From the day after you pay for your renewal, we offer a cooling-off period of 14 days. In which time you can change your mind for any reason and request to cancel your membership. Yoga Insurance UK will remove a £25 administration fee from the refund to cover the costs for the membership and insurance.

After these 14 days, we have a strict NO REFUND policy under any circumstances. If you wish to cancel your membership after this time, then we will do this without refund.

To cancel please contact us, giving the reason you wish to cancel.

10. Pricing

Yoga Insurance UK may change membership products and annual renewal fees at any time throughout the year. We will advise members of any changes by email 28 days before the changes take place.

11. Falsifying Information

If you have falsified any part of your application, Yoga Insurance UK reserves the right to cancel your account with no refund.

In the event of an insurance claim, Balens Ltd will ask to see a copy of your Teacher Training Certificate. If this fails to meet Yoga Insurance UK minimum standards, then your insurance will be invalid.

Should your Teacher Training Certificate be revoked by your Trainer, your membership with Yoga Insurance UK will be cancelled, with no refund.

12. Yoga Insurance UK Right to Cancel or Suspend a Membership

Possible actions which could lead to suspension of a Membership, (this list is not exhaustive)

1. There are ongoing or frequent complaints from students who attend your classes/workshops/events.

2. You make either defamatory comments or slanderous remarks about Yoga Insurance UK either verbally or written within the public domain.

3. You act aggressively towards a member of the Yoga Insurance UK team.

If we have to cancel your membership and insurance because of your actions, Yoga Insurance UK will notify you by email. There will be no refund given.

13. Change to Details/Circumstances

If you change your contact or personal details throughout the year, please contact us. It is your responsibility to inform us of any changes to your personal information.

There is a £25 administration fee to reissue insurance documents.

14. Contact Details

Yoga Insurance UK must have a valid telephone number and postal address for you at all times, as we may need to contact you to discuss your membership. If we are unable to contact you, then your insurance may be invalid.

15. Insurance Condition of Sale

Yoga Insurance UK will give the acceptance of your insurance on the understanding that:

1. You have never been convicted of, or charged (but not yet tried) with any criminal offence other than motoring offences or offences that are spent under the Rehabilitation of Offenders Act 1974.
   

2. You have never had a proposal or renewal for insurance declined or cancelled; a policy voided, withdrawn or suspended, or special terms imposed by any insurer.
   

3. There have been no claims or incidents which have or could give rise to a claim under a policy involving negligence, error or omission, nor are you aware of any circumstances which may revert to such a claim or suit being made against you.
   

4. You have never been the subject of a winding-up order or company/individual voluntary arrangement with creditors; or been placed into administration, administration receivership or liquidation.
   

5. You have read and understood and agree to accept Balens Terms of Business letter. Please note the Terms of Business are available for download on our website.
   

By paying the membership fees, your insurance cover is valid when the above conditions are satisfied. If you do not meet the above requirements, please contact Balens Ltd for guidance.

In the event of complaint or allegation made against you, please contact Balens directly on 01684 580798 or email claims@balens.co.uk. Balens will then contact Yoga Insurance UK to confirm your membership is in place.

17. Third Party Content, Websites, and Services
The Service may contain links to other websites which are independent of Yoga Insurance UK. We make no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Following links to any other websites is at your own risk.

You agree that:

1. You must evaluate and bear all risks associated with, the use of any Content.

2. You may not rely on said Content.

3. Under no circumstances will Yoga Insurance UK be liable in any way for any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Service.

In addition to third party websites, Content may contain features and functionalities that link you or provide you with access to other third party content which is independent of Yoga Insurance UK. Including, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet as a whole.

Interactions with organisations or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organisations or individuals.

Make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with a third party.

You agree that Yoga Insurance UK shall not be responsible or liable for any loss or damage of any sort incurred as the result of any dealings between users of the Service. If there is a dispute between users of the Service, or between users and any third party, you understand and agree that Yoga Insurance UK is under no obligation to become involved.

If you have a dispute with one or more Service users, you forever release Yoga Insurance UK, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes of the Service.

18. Privacy and Information Disclosure

If we receive a UK Government Access Request, search warrant, court order, subpoena or request from the Information Commissioners Office or equivalent Yoga Insurance UK may have to disclose your personal information legally. Such information as, email addresses, IP addresses, timestamps, and other user information.

Yoga Insurance UK Privacy Policy governs the preservation of your personal information.

19. Conduct

Yoga Insurance UK accepts no liability or responsibility for a member's conduct, behaviour or actions during the tenure of their membership.

Yoga Insurance UK is not liable for any claim arising out of the performance, non-performance, delay in delivery of or defect in the services of Yoga Insurance UK members. Nor for any special, indirect, economic or consequential loss or damage howsoever arising or howsoever caused (including loss of profit or loss of revenue) whether from negligence or otherwise in connection with the supply, functioning or use of services rendered from Yoga Insurance UK members.

20. No Spam Policy

You understand and agree that sending unsolicited email advertisements to Yoga Insurance UK email addresses is expressly prohibited.

21. Limitations on Service

You acknowledge that Yoga Insurance UK reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice and that Yoga Insurance UK shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service.

22. Termination of Service

You agree that Yoga Insurance UK, at its sole discretion, has the right (but not the obligation) to delete or deactivate your membership, block your email or IP address, if Yoga Insurance UK believes that you have acted inconsistently with the Terms of Use.

23. Proprietary Rights

Copyright laws protect the Content displayed on the Service. Any reproduction, modification, creation of derivative works from or redistribution of the site or the collective work, and copying or reproducing the sites or any portion thereof to any other server or location for further reproduction or redistribution is prohibited without the express written consent of Yoga Insurance UK.

You further agree not to reproduce, duplicate or copy Content from the Service without the express written consent of Yoga Insurance UK, and agree to abide by all copyright notices displayed on the Service. You may not decompile or disassemble, reverse engineer or otherwise attempt to discover any source code contained in the Service.

Without limiting the preceding points, you agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any aspect of the Service. Yoga Insurance UK, as well as the variation of our name, logos, and materials displayed on https://www.insurance.yoga/ constitute trademarks, trade names, service marks or logos ("Marks") of Yoga Insurance UK or other entities. You are not authorised to use any such logos. Ownership of all such logos and the goodwill associate remains with Yoga Insurance UK or those other entities.

24. Disclaimer of Warranties

You agree that use of Yoga Insurance UK and the service is entirely at your own risk. Yoga Insurance UK and the Service are provided on an "as is" or "as available" basis, without any warranties of any kind. We do not offer any warranties as to the reliability, timeliness, accuracy, and performance of this website and the service.

25. Limitations of Liability

Under no circumstances shall Yoga Insurance UK be liable for direct, indirect, incidental, special, consequential or exemplary damages (even if Yoga Insurance UK is advised of the possibility of such damages), resulting from any aspect of your use of the website or the service.

Yoga Insurance UK will not be liable if damages arise from use or misuse of the website or the Service, from an inability to use the website or the service, or the interruption, suspension, modification, alteration, or termination of the website or the service.
Yoga Insurance UK will not be held liable concerning damages incurred because of other services or products received through or advertised in connection with the website or the service or any links on the website or the service. Any information or advice you receive through or advertised in connection with the website or the service or any links on the website.

28. Indemnity
You agree to indemnify and hold all Yoga Insurance UK employees, its directors, successors, service providers and suppliers, harmless from any claim or demand made against you by a third party arising from Content you submit or post on the Service.

29. General Information
The Terms of Use, and any additional terms to which you agree when using particular elements of the Service, constitute the entire agreement between you and Yoga Insurance UK and governs your use of the Service, superseding any prior agreement between you and Yoga Insurance UK.

30. Governing Law

These Terms are governed by Scottish Law, and you hereby submit to the exclusive jurisdiction of the Scottish Courts.
